Dear Colleague Letter and Resource Guide on Students with ADHD clarifies and provides guidance on the Federal obligations of school districts that receive Federal financial assistance from the U.S. Department of Education (the Department) to students with attention-deficit/hyperactivity disorder (ADHD) under Section 504 of the Rehabilitation Act of 1973 (Section 504) and the Department’s implementing regulations. This Federal law prohibits discrimination on the basis of disability and requires school districts to provide an equal educational opportunity to students with disabilities.
